Is CMS Made Simple a brand or can anybody use the name?

I was astonished to find today this ad on google search (see attach). Hmmm...

I unfortunately do not own a trademark on the name -- so there isn't much I can do at this point.  I really need to work on getting that, but it's a paperwork nightmare.
