To be honest, I don't know how that works.

Technically I have a copyright on the code, and I would hope the project name, but I really don't know for sure.  It's not technially being used for anything involving my project, so it's not a big issue now.  Any of you smart people out there have any idea how that works?

In Germany you need to "buy" a brand or have it registered as a trademark. Then you can claim it as a brand. Otherwise it will be difficult if you do not have a company named like that that is a Ltd. or Inc. or whatever registered companies there may be. At least it needs to be registered.

When I last looked (about one week ago), cmsmadesimple.de was still available. So it must be a fresh registrar. Maybe it would be just enough to kindly ask him to release the domain --- if needed. But looking at Mambo and the brand conflicts there it might be a good idea to do some fundraising for making CMSMS (and maybe even that abbreveation) a brand or a trademark.

Maybe we should have a plugin like this one. ;o)

I talked to Andreas via email and everything is fine for now.  Though, yes, it would probably be a good idea to register the trademark at some point down the road.  My long term plans include starting an American LLC, though with a different name.  Though that, I would want to trademark the name in several countries.  I'm hoping that I can wait awhile before going through that paperwork nightmare, though...
