I did some simple tests in default installation and variable is available.

It would need further debugging on your install. Not sure if possible but perhaps some UDT or module is killing the smarty variable along the process?

Found the problem. The cookie consent overlay does not work if browser caching is enabled.

You have Smarty Caching switched off?
