I deleted everything (for the third time), reuploaded all the CMSMS files in binary via FTP once again... went through the installation again... everything good... here is what I noticed...
The first thing I did was to place the site under maintenance (Site Down Settings)... and it turns out that when you have this option on (Enable Site Down Message:) the content blocks DON'T SEEM TO WORK! try it...
I did this three times to make sure... so I would set the site under maintenance, and then I would go and create a new template, and I would get the error!! then I went to uncheck the maintenance setting, went back to create a template and BAM! it works...
Hope this helps with something...

and put you IP ADDRESS AT
Exclude these Addresses from Site Down Messages:
This way the new template will work
I think that the behaviour is correct: the database will be protected, preserved.

Its working guys!
But I dont know if its a protection for the site or just a pure procedural error..
