diff 1.9.4.3 error 'file exists'

On two seperate installs (1.9.4.2) trying to tar -zxvf the diff file, I get "
tar: ./admin/lang/ext/en_CY: Cannot open: File exists"
All other files appear ok. any ideas?
the folder exists and has admin.inc.php and index.html in it
